Corrientes: una joven víctima de abusos logró dar en adopción a su hija antes de nacer
Una adolescente de la localidad correntina de Alvear otorgó en adopción a una hija antes de nacer, luego de que una jueza autorizara el trámite e iniciara una demanda contra su padrastro por haber cometido reiterados abusos sexuales en su contra. La jueza de Familia de la ciudad correntina de Paso de los Libres, Marta Legarreta, en un fallo de cinco páginas, decidió otorgar a una pareja, con carácter cautelar, urgente y condicionada a la ratificación del consentimiento materno en un plazo de 45 días, el cuidado personal provisorio de una niña nacida un día después del fallo, que data del 12 de julio pasado.
El matrimonio que obtuvo la tenencia provisoria es de Paso de los Libres y logró la autorización de la magistrada de retirarse con la niña recién nacida del hospital San José de esa localidad, luego de que la joven de 18 años que inició el trámite de entrega para adopción prenatal expusiera su voluntad en el juzgado. En la misma resolución, la jueza Legarreta ordenó al hospital que le conceda a la adolescente “la mayor privacidad, confidencialidad, respetando en todo momento el derecho a la preservación de su intimidad durante el alumbramiento y estadía en el nosocomio local, no siendo preguntada ni indagada por el personal médico y de enfermería respecto de la decisión, condiciones y circunstancias y/o cualquier cuestión relacionada al embarazo y guarda del niño por nacer”. Y marcó en el dictamen que la chica debía ser asistida en “una habitación privada para su recuperación post parto”.
Asimismo, le hizo saber a la joven “que goza de plena libertad para cambiar su decisión desde el momento mismo del nacimiento del niño, o en caso de mantenerse firme, hasta ratificarla luego de los cuarenta y cinco días posteriores al nacimiento”.
El caso surgió luego de que la mujer embarazada de 23 semanas se escapara de su hogar familiar en la localidad de Alvear, a 440 kilómetros de la capital correntina, hacia la casa de una tía, en el paraje Yuquerí, ubicado en Paso de los Libres, donde tiene sede el juzgado de Legarreta, a quien acudió junto a su familiar con el propósito de pedirle autorización para la realización de un aborto. Según consta en el fallo, la menor justificó su pedido en el hecho de que el embarazo era producto de un abuso de su padrastro, quien en reiteradas oportunidades la violó e incluso, de quien tiene una hija de dos años de edad. Según señala la sentencia, el hombre la violaba desde que tenía 13 años de edad.
Tras ser debidamente informada sobre el derecho a practicarse un legrado (raspado uterino) por tener un embarazo en curso producto de una violación, la mujer acudió al hospital donde se interiorizó de los riesgos que implicaba el tratamiento, por lo que decidió entregar en adopción la niña por nacer. “¿Es necesario forzar la maternidad, obligando al niño a permanecer junto a su madre, contra su voluntad, durante el plazo previsto (45 días desde el nacimiento) para recién posibilitar optar válida o legalmente por el desprendimiento del niño a través del instituto de la adopción?”, planteó la jueza en los considerandos de la medida. Y respondió “entiendo que este requisito, en cuanto al plazo, debería ser ratificado pero no excluyente”.
